Terms & Conditions

  1. Scheduling. Dygerati Design is available to clients Monday - Friday, between 10 a.m. and 5 p.m. PST. I may not be available on weekends and will not be available on Christmas, Independence Day and Thanksgiving.

  2. No spec work. Dygerati Design does not accept work on spec.

  3. Browser compatibility. Dygerati Design represents and warrants that the web site he designs for you will work in:

    • Microsoft Internet Explorer versions 6 through 8

    • Apple Safari version 1.0 and up

    • Mozilla Firefox version 1.0 and up

    Dygerati Design will make your website compatible with any other browser, including mobile browsers, for the rate of $45 per hour.

  4. Termination of services by client. A minimum rate of $250 will be charged if completed work is refused by a client and a client does not wish to continue with a project.

    Any work refused by a client cannot be used in whole or in part.

  5. Ownership rights. Once a project has been completed, and only once the project has been paid for in full, the client will retain the right to use Dygerati Design's work for the intended purpose. Use of the work for purposes other than the intended purpose (e.g. Web design graphics used for a print ad) will require his written permission.

    Dygerati Design always retains the right to utilize any and all works in his professional repertoire or portfolio for future promotion.

  6. Forward compatibility. Dygerati Design cannot be held responsible for the changes made to new versions of Web browsers by the authors/vendors of those Web browsers. Thus, Dygerati Design does not warrant that his websites will function properly on future versions of Web browsers. If an update to a major browser causes your website to "break," his current hourly rate will be charged to fix it.

  7. Assignment of Web project. Dygerati Design reserves the right to assign subcontractors to any project to insure that the project goals are met in full and that completion is on-time.

  8. Copyrights and Trademarks. The Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Dygerati Design for inclusion in any Web Design or Web Marketing Project are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Dygerati Design and his subcontractors from any liability (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client.

  9. Late payment. Clients have a 30 day grace period to submit payment after the invoicing date. Late payments made after the grace period will be subject to a $30 late fee.

  10. Interim charge caps. Dygerati Design has set a $500 interim charge cap. When a client's total bill exceeds $500, that client will need to make an interim payment to bring the total balance lower or face work suspension.

    Dygerati Design reserves the right to waive this cap at his sole discretion.

  11. Unforeseen or sudden termination of a project. In the unlikely case that a mishap, illness or accident occurs that makes it impossible for Dygerati Design to continue a project in progress, the client will be able to retain all work completed up to that date to be used with another freelancer or design firm after any remaining balance has been paid in full.

  12. Other details. More specific details for projects will be included in the contract for that project, and will be enforced in addition to these terms and conditions.
